Identity Theft.
When your personal information (e.g. your Social Security Number, bank or credit account numbers) is used by an unauthorized person, without lawful authority, to commit financial fraud or other crimes, it is identity theft.
Payment Card Fraud.
Some acts of financial fraud related to identity theft can be more damaging that others. For example, payment card fraud is the unauthorized use of existing payment cards or card numbers. Fortunately, the payment cards industry has managed this fraud reasonably well. They can cancel compromised card accounts and issue new cards and account numbers to victims to prevent further misuse.
For many, federal law limits victim liability from fraudulent use of payment cards.
Devastating Fraud.
The most damaging identity theft can result in a person's entire financial identity being stolen and used to establish new credit without the victim's knowledge. The new credit uses account information with mailing addresses accessible only to the identity thief. They are no longer tied to the victim.
Early detection (and thus prevention) of this type of fraud is challenging. Since victims are not receiving credit account information (e.g. billing statements), it is difficult to be alerted to the fraud.
Discovering Identity Theft.
Usually, victims only learn of fraudulenty established accounts after...
- reviewing their credit reports,
- being contacted by collection agencies, OR
- being denied credit.
- contact all lenders on your credit report,
- dispute fraudulent accounts and transactions, and
- file police reports.
The payment cards industry and the government have made substantial progress in helping victims with tools to protect personal data. They help limit your liability and quicken the clean-up process. For instance, the Fair and Accurate Credit Transactions Act (FACT Act - December 2003), is aimed at combating this type of financial fraud.
Minimizing Risk of Identity Theft.
To decrease your risks, especially to the creation of new credit accounts, there are several steps you can take.
